Acceptable Use Policy

This Acceptable Use Policy ("Policy") sets out the rules for using hare ("hare," "the Service," "we," "us"). It applies to everyone who accesses or uses the Service, including all subscription tiers and any free or trial access. By creating an account or using the Service, you agree to this Policy. It forms part of, and should be read together with, our Terms of Service.

1. About the Service

hare is an AI-powered audio generation tool. It lets users generate spoken voiceovers from text, create ambient sound and atmosphere, design original synthetic voices, choose from a built-in voice library, and — optionally — clone a voice they own or have permission to use. Voice and atmosphere can be generated separately or together. The Service is intended for lawful personal, creative, educational, and commercial use. The Service is a tool — you are responsible for the content you create with it and for how that content is used.

2. Who May Use the Service

• You must be at least 18 years old, or the age of legal majority in your jurisdiction.
• You must provide accurate account and identity information and keep it up to date.
• You may not use the Service if barred under any applicable law, sanctions regime, or export-control rule.
• You are responsible for all activity under your account. Keep your credentials secure.

3. Prohibited Content

You may not use the Service to create, upload, generate, store, or distribute content that falls into any category below.

3.1 Sexual content and content involving minors

• Sexually explicit, pornographic, NSFW, or sexually suggestive audio.
• Any content that sexualizes, depicts, or involves minors in any way. This is strictly and absolutely prohibited. We report suspected child sexual abuse material (CSAM) and related activity to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC) or relevant regional bodies.

3.2 Harmful, violent, or hateful content

• Content that threatens, harasses, bullies, or intimidates any person.
• Content that promotes, glorifies, or incites violence, terrorism, or physical harm.
• Content that promotes self-harm, suicide, or disordered eating.
• Hate speech or content that demeans or promotes discrimination against individuals or groups based on protected characteristics.

3.3 Deceptive, fraudulent, and manipulative content

• Content created to scam, defraud, phish, or financially deceive others.
• Audio designed to spread misinformation, including fabricated statements attributed to real people.
• Content intended to manipulate elections or public opinion through deception.
• Fake endorsements, fabricated testimonials, or impersonation of real individuals or organizations.

3.4 Illegal and infringing content

• Content that violates any applicable local, national, or international law.
• Content that infringes the intellectual property, privacy, publicity, or other rights of any third party.
• Content that discloses another person's private information without authorization (doxxing).
• Content that promotes or facilitates illegal activity.

3.5 Malicious and abusive use

• Using generated audio as part of malware, spam, or social-engineering attacks.
• Generating audio intended to bypass security measures, voice-authentication, or identity-verification systems.

4. Voice Cloning — Consent and Ownership

Because voice is personal and sensitive, the following rules are mandatory and strictly enforced.

4.1 Consent is required

• You may only clone a voice that is your own, or one for which you hold explicit, verifiable permission from its owner.
• Before cloning, you must confirm, through our consent step, that you have the right to use the voice you submit.
• Submitting a voice you do not own and have no documented permission to use is a serious violation.

4.2 Prohibited voice cloning

You may never use voice cloning to:

• Clone or imitate the voice of a public figure, celebrity, politician, or any identifiable real person without their explicit consent.
• Create audio that impersonates a real person for deception, fraud, defamation, or harassment.
• Deceive listeners into believing a specific real person said something they did not.
• Circumvent voice-based authentication or identity-verification systems.

4.3 Your obligations

• Retain evidence of consent where you clone a voice that is not your own, and provide it on request.
• You remain fully responsible for every voice you clone and every output you generate from it.

5. No Impersonation

You may not use the Service to impersonate any individual, organization, brand, or entity, or to misrepresent your affiliation with any person or organization, including generating audio that falsely appears to originate from a real person.

6. Usage Limits and Fair Use

• Voice cloning and generation volumes are limited according to your subscription plan. The Service is built for individual and creative use, not bulk or industrial-scale cloning.
• You may not circumvent, disable, or exceed plan limits, rate limits, or technical safeguards.
• You may not resell or provide the Service's raw generation capability to third parties as your own service without our written permission.
• You may not use bots or scrapers that place unreasonable load on our systems.

7. Marketing and Representation

If you promote hare, you may not market it using terms suggesting it is unrestricted or designed to bypass safety rules — including "uncensored," "no filter," "no limits," or equivalent. The Service operates within the boundaries of this Policy at all times.

8. Intellectual Property and Outputs

• You are responsible for ensuring your inputs do not infringe any third party's rights.
• You are responsible for how you use the audio you generate, including obtaining any licenses your intended use requires.
• The AI models underlying the Service are used under licenses that permit commercial use. This does not relieve you of responsibility for your own inputs and outputs.

9. Privacy and Personal Data

• Do not upload voice samples or personal data of other people without a lawful basis and, where required, their consent.
• Handle any personal data you process using the Service in compliance with applicable data-protection laws (such as the GDPR where it applies).
• Our handling of your data is described in our Privacy Policy.

10. Reporting Abuse

If you encounter content generated with the Service that you believe violates this Policy — including impersonation, non-consensual voice cloning, or harmful content — please report it to support@hareaudio.com. We review reports and take appropriate action.

11. Enforcement

• We may investigate suspected violations and review account activity and content where we reasonably believe a violation has occurred or where required by law.
• We may remove content, restrict features, issue warnings, suspend, or permanently terminate accounts — at our sole discretion, with or without prior notice.
• We may preserve, disclose, and report activity to law enforcement where necessary. Content involving minors is always reported.
• A violation of this Policy is also a violation of our Terms of Service.

12. Changes to This Policy

We may update this Policy from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify users. Continued use after changes take effect constitutes acceptance.

Terms of Service

Welcome to hare ("hare," "the Service," "we," "us," "our"). These Terms of Service ("Terms") are a binding agreement between you and the operator of hare. By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. These Terms incorporate our Acceptable Use Policy and Privacy Policy by reference.

1. Who We Are

The Service is currently operated by an individual sole proprietor based in Poland ("the Operator"). Contact details are in Section 16. As the Service grows, it may be transferred to or operated by a registered company; if that happens, we will update these Terms and notify users where required.

2. Eligibility

• You must be at least 18 years old, or the age of legal majority in your jurisdiction.
• You must be able to form a legally binding contract.
• You must not be barred from using the Service under any applicable law, sanctions, or export-control rule.
• If you use the Service for an organization, you confirm you have authority to bind it.

3. Your Account

• You are responsible for the accuracy of the information you provide and for keeping it up to date.
• You are responsible for safeguarding your credentials and for all activity under your account.
• Notify us promptly of any unauthorized use of your account.
• We may refuse, suspend, or terminate accounts as described in these Terms and the Acceptable Use Policy.

4. The Service

hare is an AI-powered tool that generates audio from text and other inputs you provide. It includes spoken voiceover generation, ambient sound and atmosphere creation (separately or combined with voice), a voice library, the ability to create original synthetic voices, optional consent-based voice cloning, a personal generation history, and a shared library. The Service is under active development; features, usage limits, credit allowances, and plan structures may change over time.

5. Acceptable Use

Your use of the Service is governed by our Acceptable Use Policy (AUP), which prohibits unlawful content, sexual content, content involving minors, harassment, impersonation, fraud, non-consensual voice cloning, and similar misuse. A violation of the AUP is a violation of these Terms.

6. Voice Cloning and Consent

Where you use voice cloning, you confirm and agree that:

• The voice you submit is your own, or you have explicit, verifiable permission from the person who owns it.
• You will not clone or imitate the voice of any identifiable real person — including public figures — without their consent.
• You will not use cloned voices for impersonation, deception, fraud, or any purpose prohibited by the AUP.
• You are solely responsible for the voices you submit and the audio you generate, and will retain proof of consent where the voice is not your own.

7. Subscriptions, Credits, and Payments

• The Service is offered through subscription plans, each including a set allowance of credits used to generate audio.
• Payments are processed by a third-party Merchant of Record and payment provider, which acts as the seller of record and handles billing, taxes, and related matters. Your purchase is also subject to the Merchant of Record's terms.
• Prices, plan features, and credit allowances will be published before launch and may change over time, with notice of material changes where required.
• Unless required by law or expressly stated, fees are non-refundable once a billing period or credits have been used. Refund eligibility may also be governed by the Merchant of Record's policies and applicable consumer-protection law.
• You are responsible for any taxes not handled by the Merchant of Record where applicable.

8. Your Content and Inputs

• "Inputs" means the text, voice samples, and other material you provide. "Outputs" means the audio the Service generates for you.
• You retain ownership of your Inputs and represent that you have all rights necessary to provide them.
• As between you and us, you own the Outputs you generate, subject to your compliance with these Terms and the AUP. You are responsible for how you use them.
• You grant us a limited license to process your Inputs and Outputs as necessary to operate and improve the Service, as described in our Privacy Policy.

9. Intellectual Property

• The Service — including its software, design, branding, and content we provide — is owned by the Operator or its licensors. These Terms grant you only the limited right to use it in accordance with these Terms.
• The AI models underlying the Service are used under licenses that permit commercial use; no ownership of those models transfers to you.
• You may not copy, modify, reverse-engineer, resell, or create derivative works of the Service, except as permitted by law.

10. Prohibited Conduct

In addition to the AUP, you agree not to use the Service unlawfully; interfere with or place unreasonable load on the Service; attempt unauthorized access to the Service, other accounts, or our systems; circumvent usage or rate limits; use bots or scrapers except as we permit; or resell the Service's capabilities as your own without written permission.

11. Suspension and Termination

• You may stop using the Service at any time.
• We may suspend or terminate your access, with or without notice, if you violate these Terms or the AUP, if required by law, or to protect the Service, other users, or third parties.
• Upon termination, your right to use the Service ends. Provisions that should survive (ownership, disclaimers, limitation of liability, governing law) will survive.

12. Disclaimers

• The Service is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law.
• We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Outputs will be accurate or fit for any particular purpose.
• AI-generated audio may contain errors. You are responsible for reviewing Outputs before relying on or publishing them.

13. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our total liability for any claim will not exceed the greater of (a) the amount you paid us in the three months before the event giving rise to the claim, or (b) a nominal amount permitted by law. Nothing here limits liability that cannot be limited under applicable law, including mandatory consumer-protection rights.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless the Operator from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your Inputs, your Outputs, your use of the Service, or your violation of these Terms or the AUP.

15. Changes to the Service and Terms

We may modify the Service and these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service.

16. Governing Law and Contact

• These Terms are governed by the laws of Poland, without regard to conflict-of-laws principles, except where mandatory consumer-protection law in your country of residence provides otherwise.
• Where permitted, disputes will be subject to the competent courts of Poland. This does not deprive consumers of protections under the mandatory law of their place of residence.

Privacy Policy

This Privacy Policy explains how hare ("hare," "we," "us," "our") collects, uses, and protects your personal data when you use the Service. We are committed to handling your data responsibly and in line with applicable data-protection laws, including the EU General Data Protection Regulation (GDPR) where it applies. By using the Service, you agree to the practices described here.

1. Who Is Responsible for Your Data

The Service is currently operated by an individual sole proprietor based in Poland ("the Operator"), who acts as the data controller for personal data processed through the Service. Contact details are in Section 11. If the Service is later operated by a registered company, we will update this Policy.

2. What We Collect

• Account data — username, nickname, password (stored in protected form), and, where provided, your email address.
• Content you provide — text prompts, voice samples, other inputs, and the audio outputs generated for you.
• Usage data — generations, activity logs, plan and credit usage, and technical data like device and browser type, IP address, and timestamps.
• Payment-related data — handled by our third-party Merchant of Record and payment provider; we do not store full card numbers and receive only limited information such as plan, transaction status, and data needed to manage your subscription.
• Communications — messages you send us, such as support requests or abuse reports.

3. Voice Data

Voice samples you upload (including for voice cloning) are personal and, in some cases, biometric data. We process them only to provide the voice features you request. You must only upload a voice that is your own or that you have explicit permission to use, as required by our Acceptable Use Policy and Terms. You may request deletion of your voice data as described in Section 8.

4. How We Use Your Data

• Provide, operate, and maintain the Service, including generating audio you request.
• Manage your account, subscription, and credits.
• Communicate with you about the Service, including service updates and waitlist notifications.
• Maintain security, prevent abuse, and enforce our Terms and Acceptable Use Policy.
• Improve and develop the Service.
• Comply with legal obligations and respond to lawful requests.

5. Legal Bases for Processing (GDPR)

• Performance of a contract — to provide the Service you sign up for.
• Consent — for example, where you submit voice data or opt in to certain communications. You may withdraw consent at any time.
• Legitimate interests — securing the Service, preventing abuse, and improving our product, balanced against your rights.
• Legal obligation — where we are required to process data to comply with the law.

6. How We Share Data

We do not sell your personal data. We share it only as needed:

• Service providers — third parties that help us operate the Service (hosting, compute/GPU infrastructure, and our Merchant of Record/payment provider).
• Legal and safety — where necessary to comply with the law, enforce our Terms, or protect users and the public. Content involving minors is reported to the appropriate authorities.
• Business transfers — if the Service is transferred to another operator or company, your data may transfer as part of that change, subject to this Policy.

Some service providers may process data outside your country, including outside the EU/EEA. Where that happens and the GDPR applies, we take steps to ensure appropriate safeguards are in place.

7. Data Retention

We keep personal data only as long as necessary for the purposes described here, including providing the Service, complying with legal obligations, resolving disputes, and enforcing our agreements. When data is no longer needed, we delete or anonymize it.

8. Your Rights

Depending on your location, you may have the right to access, correct, delete, restrict, or object to processing of your data; to data portability; to withdraw consent; and to lodge a complaint with a data-protection authority. 9. Security

We take reasonable technical and organizational measures to protect your data against unauthorized access, loss, or misuse. No system is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your credentials safe.

10. Children

The Service is not intended for anyone under 18, and we do not knowingly collect personal data from minors. If you believe a minor has provided us data, contact us and we will take appropriate steps to delete it.
